The firm represents banks and other financial institutions, as well as business creditors and debtors, in a broad range of commercial transactions, bankruptcy and creditors’ rights issues. In addition to representing commercial lenders and lessors with drafting and negotiating transaction documents such as real estate, commercial loan and equipment lease agreements, our lawyers also advise clients on the enforcement of their rights and remedies as secured and unsecured creditors. Our attorneys have substantial experience and are involved in representing commercial creditors in loan workouts, restructuring and forbearance arrangements, collection actions, replevin actions, garnishment and attachment proceedings, and bankruptcy proceedings.

The lawyers in the Firm’s Bankruptcy and Creditors' Rights practice group are experienced, efficient and creative. As such, they strive to create added value and utilize leverage to their clients’ advantage.

The matters handled by our attorneys include:
- Representing a national bank in connection with a revolving portfolio of collections on delinquent loans;
- Representing an asset-based health-care lender in creating its entire loan document package;
- Representing an equipment lessor in connection with replevin of equipment from corporate lessees;
- Representing a lender in a lawsuit against the original corporate borrower, the successor corporation to the original corporate borrower, and the individual guarantor for recovery of obligations incurred by the original borrower;
- Representing a secured lender in connection with a delinquent account and subsequent drawing under standby letter of credit to liquidate the borrower’s obligations to the lender;
- Representing numerous commercial lenders and lessees in connection with various bankruptcy proceedings of their respective obligors;
- Representing corporate borrower in connection with settling, at a large discount, the borrower’s obligations to an out-of-town bank.
